Rather than a heavy fine, I would like to see community service that would help the birds. For example, this company would talk to at least 100 other tree trimming services about the importance of not trimming trees when birds are nesting there. The workmen who did the actual work should be made aware that what they did was not only illegal, it was cruel. Neighbors were begging them to stop, so they absolutely knew they were harming (killing) babies. As far as the USPS is concerned, it is protected by so many layers of bureaucracy that nothing will happen. But I think the person who called the tree trimmers should be educated. The City of Oakland has no blame here. In fact, it may be one of the plaintiffs should there be a lawsuit (which I doubt, unless an entity such as Audubon brings it forward). Oakland does not cut the trees it owns during Baby Bird Season. And it requires prior notice when 25% or more of a tree is trimmed. I assume these are street trees that are trimmed for telephone wires, etc., but I am not sure which trees are included.
I may have made a mistake when I didn't pick up the second BCNR chick. He looked so healthy, and he was able to climb (or fly) up to the top of a bush. I assumed he was a fledgling, and we know to leave fledglings alone. On the other hand, he could have wandered around in a heavily trafficked area. I did go back yesterday to see if he was still there. He wasn't. I hope he either is back in the tree or has left with his parents. I just don't know.
